Platform Legal Agreements

These agreements govern use of the Request-it.live platform operated by Request It Live Ltd (“Company”, “we”, “us”, “our”).

Use of the platform constitutes acceptance of the relevant agreement below depending on your role.

Agreement 1 — Fan Terms of Use

1. Role

Fans are audience users who browse performers, submit requests, and optionally send tips.

2. Eligibility

You must be 18 or over.

3. Permitted Use

You may use the platform to:

  • Submit song requests
  • Follow performers
  • Participate in live sessions
  • Send voluntary leads or tips

4. Prohibited Conduct

You must not:

  • Harass performers
  • Send offensive requests
  • Abuse tipping systems
  • Impersonate others
  • Attempt platform disruption

5. Tips

Tips are voluntary and are given as appreciation for the overall performance experience, not for any specific song request.

Users acknowledge:

  • A tip does not guarantee a request will be played
  • Performers retain full discretion over set lists and song choices
  • Tips are not conditional payments for specific songs

All tips are final and non-refundable, including where a requested song is not performed, unless required by law.

Monitoring & Compliance

We actively monitor tipping activity for fraud, abuse, suspicious behaviour, or potential unlawful conduct. Any unexplained, irregular, or suspicious transactions may be investigated and, where required, reported to relevant financial institutions, regulators, or law enforcement authorities.

6. Account Suspension

We may suspend accounts for misconduct without notice.

7. Liability

The platform is provided “as is”. We are not liable for performance outcomes, events, or third-party conduct.

Agreement 2 — Performer Terms

1. Platform Role

We provide software tools only. We are not your employer, agent, or manager.

2. Subscription

Performer features may require a paid subscription.

Current pricing:

  • £4.99 GBP per month
  • € equivalent regional price

Subscriptions renew automatically until cancelled.

Cancellation

Cancellation stops renewal but access continues until the end of the paid billing period. No partial refunds are issued.

Failed Payments

We may restrict access after failed billing attempts.

3. Earnings Disclaimer

We do not guarantee:

  • Requests
  • Tips
  • Audience engagement
  • Income

4. Tips

Venues acknowledge:

  • Tipping functionality may be enabled
  • Tips are voluntary gratuities for performers and not payments for specific songs
  • Performers are not contractually obligated to perform requested songs in exchange for tips
  • They must inform performers if tipping is prohibited
  • We are not liable for tip disputes

Monitoring & Compliance

We actively monitor tipping activity for fraud, abuse, suspicious behaviour, or potential unlawful conduct. Any unexplained, irregular, or suspicious transactions may be investigated and, where required, reported to relevant financial institutions, regulators, or law enforcement authorities.

5. Tax Obligations

You are solely responsible for declaring earnings and paying taxes or VAT where applicable.

6. Acceptable Use

You must not:

  • Misuse the platform
  • Manipulate requests
  • Fake sessions
  • Abuse tipping systems
  • Upload unlawful content

7. Intellectual Property

Platform software, systems, and branding remain property of Request It Live Ltd.

You may not copy or replicate any part of the system.

8. Termination

We may suspend or terminate performer accounts where:

  • Terms are breached
  • Fraud suspected
  • Platform integrity is at risk

Termination may occur without notice.

Agreement 3 — Venue Terms

1. Commercial Use

Venues using the platform confirm they:

  • Have authority to operate it on premises
  • Comply with licensing laws
  • Permit tipping where enabled

2. Platform Role

We provide technology only. We do not manage performers or events.

3. Venue Responsibility

Venues are responsible for:

  • Local compliance
  • Staff permissions
  • Financial policies
  • Performer agreements

4. Tips

Venues acknowledge:

  • Tipping functionality may be enabled
  • They must inform performers if tipping is prohibited
  • We are not liable for tip disputes

5. Misuse

We may disable platform access for venues that:

  • Attempt fraud
  • Misrepresent performers
  • Interfere with platform systems

Universal Terms (Apply to All Users)

A. Third-Party Integrations

We are not responsible for outages or failures of third-party services including payment processors or music platforms.

B. Availability

We do not guarantee uninterrupted service and may modify or discontinue features.

C. Beta Features

Beta features may change or be removed without notice.

D. Limitation of Liability

To the fullest extent permitted by law, Request It Live Ltd shall not be liable for indirect or consequential losses including lost income, data, reputation, or opportunity.

E. Indemnity

You agree to indemnify Request It Live Ltd against claims arising from your misuse of the platform or breach of these agreements.

F. Force Majeure

We are not liable for delays caused by events outside our control including outages, cyber incidents, or government action.

G. Data Protection

We process data in accordance with UK GDPR, EU GDPR, and Irish Data Protection law.

H. Changes

We may update these agreements at any time. Continued use constitutes acceptance.

I. Governing Law

These agreements are governed by:

  • Laws of England and Wales, or
  • Where applicable, laws of the Republic of Ireland

J. Severability

If any clause is invalid, remaining clauses remain enforceable.

K. Assignment

We may transfer our rights without restriction. Users may not assign rights without written consent.

Additional Legal Protections

Financial & Regulatory Status

Request It Live Ltd operates solely as a software technology provider. The Platform does not provide payment services, banking services, escrow services, or money transmission services. Tips are discretionary gratuities between users and performers and do not constitute payments for goods or services supplied by the Company.

Nothing within the Platform shall be interpreted as creating a financial service, regulated payment service, or fiduciary relationship.

Payment Processor Responsibility

All payment transactions are handled by third-party payment processors. We do not store or control payment credentials and are not liable for processor errors, delays, chargebacks, or financial losses arising from third-party systems.

Liability Cap

To the fullest extent permitted by law, the total aggregate liability of Request It Live Ltd arising out of or relating to use of the Platform shall not exceed the total amount paid by the user to the Company in the twelve (12) months preceding the claim.

Dispute Resolution

Before issuing legal proceedings, parties agree to attempt resolution by written notice and good-faith negotiation for a minimum of 30 days.

Jurisdiction Priority

Primary jurisdiction shall be England and Wales unless mandatory local law requires otherwise. Where required, Irish law shall apply for users located in the Republic of Ireland.

Service Level Disclaimer

We do not guarantee uptime, availability, response time, or uninterrupted service. The Platform is provided on a best-efforts basis.

No Partnership

Nothing in these agreements creates any partnership, joint venture, agency, or employment relationship between the Company and any user, performer, or venue.
